This is exactly what happened in a case that is being appealed to the U.S. Supreme Court. The case is called MKB vs. Warden. We do not even know the person involved; MKB are initials. The case was tried and appealed but there is no public record of anything. Here is an excerpt from the petition to the High Court:
"The entire dockets for this case and appeal, every entry in them, are maintained privately, under seal, unavailable to the public. In the court of appeals, not just the filed documents and docket sheet are sealed from public view, but also hidden is the essential fact that a legal proceeding exists."
In other words, as far as any American citizen is concerned, nothing happened! Scary!
Due to an error by a clerk, it appears that MKB is an Algerian in South Florida, who was detained by immigration officials and has been free on a $10,000 bond since March 2002. It does not sound like this person is a terrorist. But who knows? It's a secret.
You can read the full report about this in Warren Richey's article in the Christian Science Monitor, Secret 9/11 Case Before High Court.
The Bush administration is secretive about everything in the name of security. But secrecy does not produce security. Secrecy destroys security. Secret justice is justice denied. Without justice there is no security.
We must call a halt to secrecy, especially in judicial proceedings. Let's bring back real justice to the U.S.
